The 83 — EightThree Business Consulting LLC
The 83 ("Provider") will build, host, and maintain a website for the client's restaurant business ("the Site").
Included:
"Updates" means: changes to hours, menu items and prices, photos, announcements, holiday closures, contact information, and similar content updates.
No setup fee.
12-month minimum commitment. The initial term is 12 months from the start date.
Early cancellation: If the client cancels before 12 months, the remaining balance is due. For example, canceling at month 4 on the monthly plan means 8 × $99 = $792 is owed. This reflects the Provider's upfront investment in building the Site.
After 12 months, the agreement converts to month-to-month (monthly plan) or renews annually (annual plan). Either party may cancel with 30 days' written notice after the initial term.
Provider aims to complete text-message change requests the same day they are received during business hours (Monday–Friday, 9 AM – 5 PM Arizona time).
This is a goal, not a guarantee. Complex changes, high volume, or requests received outside business hours may take longer. Provider will communicate if a request will take more than 48 hours.
Domain name: Owned by the client. If Provider registers the domain on the client's behalf, it will be transferred upon request at no charge.
Site content (menu text, photos provided by client, business information): Owned by the client.
Site design and code: Owned by Provider, licensed to the client for the duration of the paid subscription.
If the Site links to third-party ordering or delivery services, the client is solely responsible for those accounts, fees, and relationships. Provider only places the links.
The client is responsible for the accuracy of all business information provided, including menu items and prices, hours of operation, allergen information, and nutritional claims.
Provider will publish what the client provides via text message. Provider is not liable for errors in client-provided content, including incorrect prices, missing allergen warnings, or wrong hours.
Client should review their live site after any change and notify Provider immediately of errors.
Provider's total liability is limited to the fees paid by the client in the 12 months preceding the claim.
Provider may update this agreement with 30 days' written notice. Continued use after the notice period constitutes acceptance.
